1. Scope

These terms and conditions apply to all orders placed with recordsupplies, operated by Merlin Müller-Alpers (see imprint), by consumers and business customers alike.

2. Conclusion of contract

The presentation of products on this website does not constitute a binding offer, but an invitation to place an order. By sending a request via the contact form or by e-mail, you submit a binding offer to purchase. The contract is concluded once your order is confirmed in writing (e-mail).

3. Prices and shipping costs

All prices are quoted in Euro (€) and include statutory German VAT where applicable. Shipping costs are not included and will be communicated individually before an order is confirmed, since orders are currently processed by hand rather than through an automated checkout.

4. Payment and delivery

Accepted payment methods (e.g. bank transfer, PayPal) and delivery times are agreed individually per order and confirmed by e-mail. Please also see the current production and pre-order timeline on the about page.

5. Right of withdrawal

Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period will expire fourteen days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods.

To exercise the right of withdrawal, you must inform us (recordsupplies, Merlin Müller-Alpers, Odenwaldstr. 59, 51105 Köln, merlin@recordsupplies.eu) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an e-mail). You may use the model withdrawal form below, but it is not obligatory.

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for supplementary costs from choosing a delivery type other than the cheapest standard delivery we offer), without undue delay and in any event not later than fourteen days from the day we are informed about your decision to withdraw. You will have to bear the direct cost of returning the goods.

6. Warranty

Statutory warranty rights apply. For new goods, the limitation period is two years from delivery.

7. Liability

We are liable without limitation for damage resulting from injury to life, body or health caused by us, and for damage caused by intent or gross negligence. For damage caused by ordinary negligence, we are only liable insofar as an essential contractual obligation has been breached; in this case, liability is limited to the foreseeable, typically occurring damage.

8. Applicable law and place of jurisdiction

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of residence.

9. Online dispute resolution

The European Commission provides a platform for online dispute resolution (ODR), available at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
